Union views NHL plan as small step forward

NEW YORK (AP) ? NHL labor negotiations will resume Thursday after the players' union reviewed management's proposal and saw it as only a small step forward to ending the monthlong lockout.

The NHL made the proposal Tuesday in what it said was an attempt to preserve a full 82-game schedule. The league publicly released the plan Wednesday.

NHL players' union head Donald Fehr met with players to formulate the union's response. In a letter to players and agents, he said the management plan would cost his members more than $1.6 billion over six years.

"Simply put, the owners' new proposal, while not quite as Draconian as their previous proposals, still represents enormous reductions in player salaries and individual contracting rights," Fehr said in the letter, according to a report by TSN. "As you will see, at the 5 percent industry growth rate the owners predict, the salary reduction over six years exceeds $1.6 billion. What do the owners offer in return?"

The lockout began Sept. 16 and last week the league canceled regular-season games through Oct. 24. NHL Commissioner Gary Bettman, in announcing the new proposal, called it "a fair offer for a long-term deal" and "one that we hope gets a positive reaction."

"We're studying it and we're trying to get ready to give a response tomorrow," said union lawyer Steve Fehr, brother of the union leader.

In the midst of their third lockout since 1994, owners gave the union what the league called a "proposal to save 82-game season." The NHL said it hoped a deal would be reached by Oct 25 and the season would start by Nov. 2, three weeks behind schedule.

"We do not yet know whether this proposal is a serious attempt to negotiate an agreement, or just another step down the road," Donald Fehr wrote. "The next several days will be, in large part, an effort to discover the answer to that question."

NHL spokesman Frank Brown said the league was not responding to Fehr's letter.

The NHL released details of its offer for a six-year deal with a mutual option for a seventh. The plan includes a 50-50 split in hockey related revenue

The NHL proposed in July to cut the percentage of hockey related revenue from 57 percent to 43 percent, then increased its offer in September to about 47 percent.

Winnipeg Jets forward Olli Jokinen called the plan a "starting point," according to The Canadian Press.

Management included a provision to ensure players receive all money promised in existing contracts, but the union is concerned with what management termed the "make-whole provision." If the players' share falls short of their $1.883 billion in 2011-12, up to $149 million in the first year of a new deal and up to $62 million in the second would be repaid to players as deferred compensation. However, the union believes that money would be counted against the players' share in later years.

The latest proposal also includes:

?A listed salary cap of $59.9 million for the 2012-13 season, with a provision each team could spend up to $70.2 million during a transition season.

?Changing eligibility for unrestricted free agency from age 27 or seven years of service to age 28 or eight years of service, down from 10 years of service in the league's earlier proposal.

?Increasing eligibility for salary arbitration from four years to five years.

?Including all years of existing contracts beyond five years against a team's cap, regardless of where a player is playing. If a player is traded and retires or stops playing, the applicable cap charge would be applied against the team that originally signed the contact.

?The reduction of entry-level contracts to two years.

?A term limit on any contract beyond that set at five years and a stipulation that the average annual value can only vary up to five percent. This is a mechanism designed to eliminate long-term, back-loaded contracts. The NHL wants to prohibit lengthy deals, such as the $98 million, 13-year contracts Minnesota agreed to in July with forward Zach Parise and defenseman Ryan Suter.

?The elimination of re-entry waivers.

?Increasing the annual revenue sharing pool by 33 percent to $200 million, assuming annual league revenue of $3.033 billion, with a provision that half the pool be funded by the 10 teams with the highest gross revenue. A cutout against clubs in large media markets, such as Anaheim, New Jersey and the New York Islanders, and clawbacks against not selling enough tickets would be eliminated. A new revenue sharing committee, which would include NHLPA representation, would have input to determine distribution.

Among the items not addressed in the league's public detailing of its offer was realignment, drug testing or the NHL's participation in the 2014 Olympics in Sochi, Russia.

Dale Pillow: Breast Cancer's 1 Percenter

For years, Dale Pillow knew he had a hard lump under his left breast but he didn't think much about it. Breast cancer was a woman's disease, he figured. Last July, the 62-year-old divorced father of two learned otherwise. Male breast cancer accounts for 1 percent of all breast cancers, and a man has a one in 1,000 chance of developing it. Most men impacted are between age 60 and 70 -- and Pillow was one of them.

Pillow had a radical mastectomy on Aug. 7. Additional tumors were found in his lymph nodes and those removed as well, and he is undergoing an aggressive protocol of chemotherapy, which will be followed by radiation. He has but one request: With October being Breast Cancer Awareness Month, he'd like Ellen DeGeneres to help him spread the word that men aren't immune to the disease. He's applied to be a guest on her show.

Pillow, as part of his one-man public awareness campaign for male breast cancer, posed with 99 female breast cancer survivors on the steps of the Leflore County Mississippi courthouse in Greenwood -- all wearing royal blue tee-shirts with pink letters that included a twitter handle and slogan:

"#dontforgetthe1%
It?s not just a girl thing."

Pillow stands in the front, alone, in the photo shot by local photographer Johnny Jennings from a perch on a ladder.

Pillow said he had no trouble finding 99 women breast cancer survivors. "We put out the word through our churches and 112 showed up." His daughter, Elizabeth Day, who works in marketing for St. Jude Children?s Research Hospital in Memphis, got the shirts designed and the event publicized.

"I've known quite a few women who had breast cancer, but never a man," Pillow, a farmer, said. "And when people would hear about my situation, they would first say how sorry they were to learn about it and then they'd always comment how they didn't know men could get breast cancer too. Every one needs to learn the facts, and men need to be doing self-exams the same as women."

What's his goal? "To get on the Ellen DeGeneres show and let the world know about male breast cancer," he said. Ellen, are you listening?

A story in today?s?Daily Mail?tells how the ?big 3? Internet giants, Twitter, Google and Facebook are planning to block a bill being introduced in the UK parliament?which requires them to store all data for a year so that security agencies, police and councils can request its disclosure at a later date.

The Internet giants were interviewed by a cross party committee of UK MP?s and they have all come out apparently fighting the?draft Communications Data Bill.

?They reveal directors from Google, Facebook, Yahoo!, Microsoft and Twitter believe the Bill would breach users? privacy and allow repressive regimes to spy on Britons.?

?Facebook said it might go to court to resist the new law, while Google and Twitter executives said they could refuse to unlock encrypted data if the Government were to seek the information via third-party providers such as BT.?

Now I?d say that it doesn?t even matter if these companies, which are all spying on us for their own marketing purposes anyway, say they are sticking up for privacy. Especially when it has been shown time and time again that companies like Microsoft and Google help the NSA and other?US secret service 3 letter acronyms anyway.

We now have the all invasive TRAPWIRE system that is linking up CCTV cameras and spying on US citizens?constantly, along with the city sized computer base under UTAH to hold and analyse all the data that is being constantly collected on US citizens which is apparently now all perfectly legal.

There is no doubt in my mind after the EU caved in on banking data transactions that these systems will be linked up in future to the UK who is already the most?surveillance?country if you go by the number of CCTV cameras that follow us around day and night.

Is it another case of let the ?plebs?? think they are pushing big brother back a bit whilst all the time lying to our faces as our personal data is stored by a multitude of electronic databases.

Systems as old as ECHELON?which was created by the West to spy on the USSR and Eastern Bloc countries but after the cold war was turned on our own citizens.

To get round laws preventing the trawl method of spying that ECHELON does on their own citizens the countries involved decided to spy on each other and share the data. Australia would spy on the UK and the UK would spy on the USA and the USA on Australia. This way the national laws were bypassed and the data was shared?among?the countries anyway.

However with more and more spying methods and snooping laws being introduced in western nations there seems little need for these?pleasantries and our own countries are freely admitting to spying on us all. For our own safety of course.

You never know when those 20-30 real?remaining?al-Qaeda members left over from the times of ?the base? in the 80?s war against the USSR in Afghanistan might pop out under your bed.

Fighters who we helped train and fund and at that time we called them freedom fighters or more accurately?the Mujahideen. Our proxy fighters who over time turned into our mortal enemy/de-stabalising friends.

Al-Qaeda terrorists who we obviously have some control over and are used whenever required to overthrow nations we suddenly dislike such as Libya and Syria.

So it might seem like a ?win? when these Internet giants say to our government they will refuse to help them spy on us whilst at the same time collecting and keeping the same data for over a year, who knows for how long, by selling adverts, email lists, and details of our friend networks and who knows what else?to advertisers to make money.

Obviously there is an easy solution ? don?t use the Internet.

However it?s just too damn addictive isn?t it?

So if you don?t want to be spied on then you better go and buy a shack in the woods and wrap tin foil round your head but then it isn?t going to stop those thousands of satellites?spinning round the globe spying on you is it?

We do truly live in a world of hypocrisy and George Orwell would be dismayed how we have just allowed ourselves to walk into a world of high tech police state style?surveillance.

Is this the Sony Nexus X?

It looks like a few images of the Sony Nexus X have recently leaked. Or, well, some images of a handset claiming to be the Nexus X have leaked. We say claiming because we remain a bit skeptical. The images, of which there are two have come by way of Picasa user Mutel Yeter, who just so happens to have only posted those two images on his account. The Nexus X, which has also been referred to as the Xperia Nexus in the past appears to have the styling of a Sony handset. Not to mention, the Google branding that is centered on the backside. And looking at the display pic, that would seem to be a stock Android installation. Of course, given all we have is the picture, that could be nothing more than an image. Anyway, time will tell just how accurate this will prove to be, but in the meantime, there were those rumors of Nexus handsets coming from multiple manufacturers this time around.

Paul becomes major hurricane in Pacific off Mexico

LOS CABOS, Mexico (AP) ? Hurricane Paul rapidly strengthened into a major Category 3 storm in the Pacific Ocean off Mexico on Monday, prompting a hurricane warning for a swath of Baja California's western coast.

The U.S. National Hurricane Center in Miami said Paul's maximum sustained winds had ratcheted up to 120 mph (195 kph) as of 8 p.m. EDT Monday. Paul was centered about 360 miles (580 kilometers) southwest of the tip of the Baja peninsula and moving north-northeast at 14 mph (22 kph).

Forecasters said Paul was expected to approach the western coast of the southern Baja peninsula by late Tuesday and be near or over the central Baja peninsula on Wednesday. The hurricane was expected to begin weakening Tuesday, the hurricane center said.

Paul is on track to bypass the heavily populated tourist areas of Los Cabos at the tip of the peninsula, and the capital, La Paz, on the eastern Gulf of California. But school was suspended Monday and Tuesday as a precaution in Los Cabos, and heavy rain and high waves closed the ports of Cabo San Lucas and San Jose del Cabo, said Wenceslao, Pettit, head of civil protection.

The storm is forecast to brush Baja's Pacific coast farther north near Puerto San Carlos, an area of sparsely populated area of fishing villages, before turning northward along the coastline. The outer cone was forecast to pass over the entire peninsula farther north in the towns of Meluge. Comondu and Loreto.

State civil protection authorities say they are monitoring the storm for possible evacuations and have sent advance teams from the federal electricity and water commissions to help maintain services during the storm.

A hurricane warning is in effect for the western coast from Santa Fe north to Puerto San Andresito, and a tropical storm warning on Baja's western flank from north of Puerto San Andresito to Punta Abrejojos and also from Agua Blanca to south of San Fe. A tropical storm watch is in effect for north of Punta Abreojos to El Pocito.

In the Atlantic, meanwhile, Rafael reached hurricane strength late Monday in the Atlantic Ocean south of Bermuda.

The hurricane center said Rafael's top sustained winds had risen to near 75 mph (120 kph), making it the ninth hurricane of the Atlantic season.

Rafael is centered about 560 miles (905 kilometers) south of Bermuda. It is moving north at 10 mph (17 kph) and forecast to pass near or to the east of Bermuda by late Tuesday.

Yeager re-enacts historic sound barrier flight

NELLIS AIR FORCE BASE, Nev. (AP) ? Sixty-five years after becoming the first human to fly faster than the speed of sound, retired Air Force Brig. Gen. Chuck Yeager is still making noise.

This time the 89-year-old Yeager, who was featured in the movie "The Right Stuff," flew in the back seat Sunday of an F-15 Eagle instead of the experimental rocket plane, Bell X-1, he piloted on the historic flight.

The F-15 took off from Nellis Air Force Base near Las Vegas and broke the sound barrier at more than 30,000 feet above California's Mojave Desert where Yeager achieved the feat on Oct. 14, 1947.

Asked by a young girl afterward if he was scared, Yeager joked, "Yeah, I was scared to death." But the legendary pilot said he continues to fly all the time and it was just another flight to him.

The flight went smoothly, and Yeager flew the F-15 as it took off and landed, said Airman Timothy Young, a Nellis spokesman. The plane was piloted by Capt. David Vincent of the 65th Aggressor Squadron at Nellis.

The aircraft broke the sound barrier at 10:24 a.m. Sunday, exactly 65 years to the minute the then-Air Force test pilot made history. At the time, the F-15 was flying over Muroc Dry Lake in California where he accomplished the feat in 1947.

On that earlier flight, Yeager took off from the Air Force test center at Muroc Field, now Edwards Air Force Base, Calif.

Yeager told reporters on Sunday that he remains grateful for what his Air Force service allowed him to achieve. He has flown more than 350 kinds of planes around the world.

"It was a great honor to have him fly out of Nellis," Young said. "We pride ourselves on training fighter pilots and to have someone of his caliber here is such an honor."

Yeager's wife, Victoria, said he had been looking forward to re-enacting the historic flight.

"This is so cool. I'm excited," she told the Las Vegas Review-Journal. "He's in the back seat where the instructor pilot sits because he's the elder statesman."

On the anniversary of the historic flight last year, Yeager flew an F-16 to reach Mach 1, the speed of sound.

John Mallinger leads Frys.com Open

SAN MARTIN, Calif. (AP) ? John Mallinger remained in position for his first PGA Tour victory, shooting a 1-under 70 on Saturday in the Frys.com Open to take a two-stroke lead into the final round.

The 33-year-old Mallinger had a 15-under 198 total at CordeValle after opening with a 66 and matching the course record with a 62 on Friday.

"I just didn't have it all. I didn't drive it as well as I did yesterday," Mallinger said. "I think I hit every fairway yesterday, and then today I just got off to a weird start. But I hung around there and made some birdies on the back nine that got me back into position. Still got lead, still got a good spot, and look forward to tomorrow."

He has finished second twice in his seven-year career on the tour, losing in a playoff to Bo Van Pelt in Milwaukee in 2009. Mallinger had the third-round lead for the second time in his career. He shared the lead at the 2009 Byron Nelson Championship and ended up tying for sixth.

"I'm going to still stay aggressive and try to make as many birdies as possible," Mallinger said. "It's going to be a birdie day. I mean, it's supposed to be nice tomorrow."

Sweden's Jonas Blixt was second after a 66. He birdied five of the last eight holes.

"The front nine is a little harder," said Blixt, coming off a third-place finish last week in Las Vegas. "The back nine you can make a couple birdies. Hopefully, I can finish like I did today.

He had a simple game plan for Sunday.

"Make birdies," Blixt said.

Charles Howell III and Jason Kokrak were 12 under. Howell had a 66, and Kokrak shot 67.

"It'll be a shootout tomorrow," Howell said. "The greens are so soft and there will be a lot of birdies, but at least I have a chance."

He won the last of two tour titles in 2007.

Kokrak is in his first year on the tour after winning twice late last year on the Web.com Tour.

"This is the first time I put myself in really good position," Kokrak said. "I just want to go out tomorrow and do the same things I did today."

At 167th on the money list, he's in danger of losing his tour card.

Vijay Singh and Brazil's Alexandre Rocha were 11 under. They shot 66.

The 49-year-old Singh won the last of his 34 PGA Tour titles in 2008. He birdied Nos. 15 and 16, eagled the short par-4 17th and closed with a par.

"I found something in my putting that's working really, really good, so hopefully tomorrow I can get some going," Singh said. "I've changed my grip a little bit and it's flowing really freely. So that's a big plus."

British Open champion Ernie Els was 5 under after a 69.

England?s pace bowling spearhead James Anderson wants Kevin Pietersen back in the side for the upcoming Test tour of India.

While speaking to media reporters on Friday, the Lancashire seamer said that the Poms need the hard-hitting top order batsman back in the ranks if they are to regain their Test No. 1 ranking, which they relinquished to South Africa this summer.

Pietersen, 32, has been out of England fold since early August, after being dropped for the third Test against South Africa, after sending some derogatory texts to the Proteas players in the preceding Test. Pietersen was also overlooked for the recently concluded ICC World T20 championship in Sri Lanka, where the Three Lions faced a Super Eights ouster following their not so impressive performances, especially with the bat.

However, the England and Wales Cricket Board earlier this month accepted that there was nothing offensive about the then captain Andrew Strauss or the coach Andy Flower in those texts, and has also agreed terms of reintegration with the Natal-born cricketer. The board handed a provisional four-month contract to Pietersen and has assured that the batsman will be soon restored in the national side. However, it is yet to be determined when will KP don the Three Lions jersey again.

Anderson on Friday said that it would be great if the hard-hitting top-order batsman could be included in the squad for the India Test series, commencing on November 15, in Ahmedabad.

"We want to get back to number one and we need our best players to do that. Kevin is one of our best, " Anderson told BBC.

"If he is there then brilliant. Hopefully we can draw a line under the whole episode and crack on with the tour of India," he added further.

England are scheduled to play four Tests and Two T20 Internationals against India in November December, before returning home for Christmas and New Year. They will go back to India in early January next year to play a five ODI series against the Men in Blue.

The controversial batsman is currently in South Africa to play for his IPL side Delhi Daredevils in the latest edition of the Champions League T20, which gets underway in Centurion today and will run until October 28.

English actor, comedian, and playwright Patrick Barlow adapted this knee-slapping 2005 farce from John Buchan?s classic 1915 adventure novel and Alfred Hitchcock?s edge-of-your-seat 1935 motion-picture thriller based on Buchan?s nail-biting espionage story.

Set in Scotland and London, this madcap stage adaptation of The 39 Steps had its world premiere in June 2005 at West Yorkshire Playhouse in Leeds, England. Revised and redubbed John Buchan?s The 39 Steps, the show had its London premiere, directed by Maria Aitken, on Aug. 10, 2006 at the Tricycle Theatre, and transferred in September 2006 to the Criterion Theatre in London?s West End, where it won the 2007 Laurence Olivier Award for Best New Comedy.

After having its U.S. premiere on Sept. 19, 2007 at Boston University, Alfred Hitchcock?s The 39 Steps made its Broadway debut, also directed by Maria Aitken, on Jan. 15, 2008 at American Airlines Theatre, later transferred to the Cort Theatre and then to the Helen Hayes Theatre, where it played for a combined total of 771 performances before closing on Jan. 10, 2010. The show starred Charles Edwards as Richard Hannay, Jennifer Ferrin as Annabella Schmidt/Pamela/Margaret, Cliff Saunders as Man #1, and Arnie Burton as Man #2, with Man #1 and Man #2 each playing dozens of characters.

Nominated for six 2008 Tony Awards?, including Best Play and Best Direction of a Play, The 39 Steps won Tonys for Best Lighting Design of a Play (Kevin Adams) and Best Sound Design of a Play (Mic Pool), plus a 2008 Drama Desk Award for Unique Theatrical Experience.

After closing on Broadway, The 39 Steps reopened Off-Broadway at the New World Stages Stage I on April 15, 2010, and played there until Jan. 16, 2011.

Long-time Raleigh Little Theatre director Haskell Fitz-Simons will stage Alfred Hitchcock?s The 39 Steps with an all-star cast that includes Jesse R. Gephart as Richard Hannay; Staci Sabarsky as Annabella Schmidt, Margaret, and Pamela; and Tony Hefner and Del Flack as the Clowns who impersonate all the other characters that Hannay encounters during his attempt to expose an espionage ring. (Gephart played one of the Clowns in Hot Summer Nights at the Kennedy?s fabulous 2011 Triangle premiere presentation of this veritable laff riot.)

RAWALPINDI?-?Prime Minister Raja Pervaiz Ashraf on Friday visited Malala Yousafzai at the hospital, saying the attack on her life was not a crime against an individual but against humanity and ?our core moral and social values?.

The prime minister enquired after the health of the girl and met her family as well.

He was told by the doctors that the next 36 hours were critical for Malala.

PML-Q President Chaudhry Shujaat Hussain, MQM?s Dr Farooq Sattar, ANP?s Haji Adeel and other ministers also enquired after Malala?s health along with the PM.

Ashraf said they had come to the hospital to pay tribute to the bravery and courage of Malala, who along with her friends was subjected to a cowardly attack by senseless people.

He said the nation stood united in condemning the brutality and degradation of those who perpetrated this crime and the poisoned mindset that sought to destroy the soul of the nation.

?The extremists attacked Malala for what she stands for, because they were scared of the power of her vision,? the PM said.

He said Malala had a simple message, ?The right for girls to be educated?.

Ashraf described Malala as a true Pakistani and the real face of Pakistan, vowing that they would not allow anyone to destroy the face of Pakistan.

?She has created a movement across Pakistan. Our girls want to follow her footprints,? he remarked.

The prime minister said he had often stated that we faced a threat from a bigoted and radicalised mindset that wanted to rob us of our cherished values of peace, pluralism, moderation, tolerance and passion for knowledge. The PM pledged to fight this mindset.

He said it was this mindset that was behind the martyrdom of Benazir Bhutto.

?I will not allow the future of our children to be endangered by the militant mindset; the enemies of Pakistan will never be allowed to succeed. We will uproot this menace of extremism and militancy and will not surrender the soul of the nation,? Ashraf said.

The prime minister said every Pakistani was praying for a complete recovery of Malala.

He said she was receiving the best-possible care and being treated by best professionals in the country.

Won?t allow terrorists to enforce their agenda: PM: Prime Minister Raja Parvez Ashraf said on Friday that a handful of terrorists would not be allowed to enforce their agenda on the country. Addressing a national conference on children?s rights, he condemned the attack on teenage education activist Malala Yousafzai in which she and her two fellow students were injured.

He said the attack on Malala was not against an individual, but an attempt to stifle our way of life.

He said such incidents would not deter the government?s resolve to protect common values and the future of country?s children. ?It gives me strength to note that the people from all walks of life and political spectrum have been unanimous in condemning this brutal act. This shows that the nation is united to preserve its values. Let us all pray for the speedy recovery of the young girls,? the PM said. He said the evil act exposes the hollowness of the extremists and the level they had sunk to.

He said the nation was under threat from an extremist mindset which wanted to rob it of its peace? moderation? tolerance and patience. ?We are fully aware of our international obligations in realizing the ideal of ensuring a world worthy for our children.

We are determined to continue our endeavours at national, regional and global levels in line with our international obligations,? he said, adding that the government was taking measures to combat violence against children. He said October 11 had also been declared as the day of children?s rights

Growing mobile ad firms nip at Google's heels

When Auntie Anne's, the pretzel chain, wanted to tempt moms in Atlanta shopping malls with free offers, it dished out coupons through smartphones that could be redeemed immediately for a free drink or other specials.?

But while the moms received the coupons on their iPhone or Android device, the power behind the campaign was not Google or Apple ? it was Millennial Media, a nimble 6-year old independent that has grabbed the No. 2 spot in mobile advertising.

Google is No.1, but the flexibility of smaller rivals is helping them catch up in a market that is expected to triple in size to more than $20 billion in the next three years, according to market research firm Gartner.

Smaller firms have the freedom to reach users who use any mobile operating system, unlike Apple, which promotes advertising on its Apple iOS platform, and Google, which handles advertising across all devices but also has its own platform, Android.

"Advertisers want to be able to reach the broadest population they can and in the mobile world, where the platforms are fragmented, this gives an opening to the providers who are truly platform neutral," Gartner analyst Andrew Frank said.

Google held 24 percent of the U.S. market last year, while Millennial had 17 percent and Apple 15.5 percent, according to market research firm IDC. Jumptap held 9.5 percent, Yahoo 7.5 percent and India's InMobi 2.2. percent.

Ireland-based Velti Plc is also chasing market share.

Investors are taking notice.

While Facebook has been pilloried for lacking a mobile strategy, shares of Millennial have jumped 76 percent from a low of $9 in early August. Shares of Velti have leaped 59 percent from a life low of $4.99 on July 25.

Millennial, a roughly $1 billion company, is a great bet for someone looking for investments in mobile advertising, said Steven Dray, a portfolio manager at investment firm AlphaOne Capital Partners LLC.

"When you get to brand advertising, which is eventually going to be a huge pile of money that's going to move from traditional advertising to mobile, I think that's where Millennial and some of the smaller players could have very good success," Dray said.

AlphaOne bought into Millennial after its initial public offering in March and holds about 40,000 shares in the company.

Despite the run-up in their shares, the smaller firms have not run ahead of the sector. Millennial trades at 4.3 times forward 12-month sales and Velti trades at 1.3 times.

While their businesses are obviously much bigger and more varied, Google trades at a multiple of 4.6 and Facebook at 6.7.

As consumers increasingly surf the Web on the go, advertisers are looking to ply them with targeted information about nearby restaurants, pubs, theaters, shops and salons.

But there's no point pitching a shampoo to a skinhead, so the secret sauce for advertisers is user information ? and Millennial's trove of user data is what CEO Paul Palmieri is counting on to give his firm an advantage.

Millennial gathers "first-party" data ? information that users provide to a publisher, or that is gleaned from surfing habits that website owners share with advertising companies.

"It is also valuable to users because the more targeted-advertising they get, the more relevant their experience ends up being," Palmieri said, although analysts say the privacy issues this raises are yet to be resolved.

The smaller companies tout their tight focus on the mobile sector, rather than worrying about how that fits in with online advertising.

"We only focus on mobile. Google on the other hand has many different things to worry about. Yes mobile is important, but is it the most important? Probably not," said InMobi CEO Naveen Tewari, although he is not complacent about the challenge.

"The only way to compete with (Google) is by innovating faster," said Tewari, who expects his 850-person company to report billions of dollars in revenue in a couple of years.

Rising competition
But the big guns are not far away. The entry of Facebook and Twitter is expected to change mobile advertising.

Facebook, which declined to comment for this story, is investing heavily in improving mobile applications and creating new metrics to measure the success of mobile advertising ? a move expected to give a fillip to the wider market.

"There is a lack of maturity in the metrics that are available for measuring mobile campaigns," Gartner's Frank said.

"That's where there's an opening for innovation that some of the larger companies are not able to satisfy today."

Twitter, too, expanded its advertising program for the iPhone and Android devices and now sells promoted tweets and advertises promoted accounts on its mobile applications timeline, rather than only on a search page.

And Google is determined not to lose its No.1 spot. It bought mobile ad platform AdMob in 2009 and its YouTube video service recently launched a new iPhone app that carries video advertisements.

The success of iPhones and Android smartphones and the fact that Google owns many popular mobile applications also helps push its mobile advertisements.

Google reported a revenue run-rate of $2.5 billion from advertisements viewed on mobile devices when it announced second-quarter earnings in July.

Road blocks
The mobile advertising model has its detractors, and some have groused that the small screen on mobile devices makes viewing advertisements difficult, while a lack of good mobile websites might keep away potential viewers.

Users tend to spend less time on their mobiles in one go and advertisements have to be designed for short attention spans.

"I think it's still a struggle. Most of the advertising that you see on mobile devices today is still predominantly not very well targeted or not very granually targeted," Frank said.

Uncertainty about how best to advertise on mobile platforms is holding back the valuations of mobile advertising firms, Baird and Co analyst Colin Sebastian said.

While industry-standard measurements are lacking, the companies argue that mobile advertising has five times the click-through rate of online advertising.

"You can touch the ad, flip the ad, move the ad, you can do things that you cannot do on a PC. Your interactivity levels are very high," Tewari said.?

Acoustic barcodes store data in sound, go on just about anything

Technologies like NFC, RFID and QR codes are quickly becoming a normal part of everyday life, and now a group from Carnegie Mellon University has a fresh take on close-quarters data it calls acoustic barcodes. It involves physically etching a barcode-like pattern onto almost any surface, so it produces sound when something's dragged across it -- a fingernail, for example. A computer is then fed that sound through a microphone, recognizes the waveform and executes a command based on it. By altering the space between the grooves, it's possible to create endless unique identifiers that are associated with different actions.

It's easy to see how smartphones could take advantage of this -- not that we recommend dragging your new iPhone over ridged surfaces -- but unlike the technologies mentioned earlier, not all potential applications envisage a personal reading device. Dot barcodes around an area, install the sound processing hardware on site, and you've got yourself an interactive space primed for breaking freshly manicured nails. We're pretty impressed by the simplicity of the concept, and the team does a good job of presenting scenarios for implementing it, which you can see in the video below. Foreclosures Split America - Real Estate Economy Watch

September?s foreclosure data showed America has become bipolar over foreclosures, with dramatic decreases in most states but increases nearly as great in judicial states where lenders are speeding up processing of defaults.

Foreclosure activity nationwide fell to the lowest level in five years in but increased in 14 judicial states, including Florida, Illinois, Ohio, New Jersey and New York as lenders begin to move on backlogged defaults after processing standards fully implementing the Attorneys General agreement take effect.

The national decrease in September marked the ninth consecutive quarter with an annual decrease in foreclosure activity and helped drop the third quarter foreclosure numbers to the lowest level since the fourth quarter of 2007. Foreclosure filings for the quarter decreased 7 percent from August and 16 percent from September 2011. Third quarter filings were down 5 percent from the second quarter and 13 percent from the third quarter of 2011, according to RealtyTrac.

In the West, declines were even more dramatic. In California, notices of defaults were down 20.7 percent from the prior month, and down 48.1 percent compared to last year. In Arizona, new foreclosures were down 37.1 percent, in Nevada down 40.1 percent, down 40.0 percent in Oregon and Washington saw new foreclosures fall 31.2 percent from August. Sales are also down with Arizona down 24.3 percent, Nevada down 19.5 percent, Oregon down 0.3 percent, and Washington down 33.5 percent from the prior month, ForeclosureRadar reported today.

Third quarter foreclosure activity increased on a year-over-year basis in New Jersey (130 percent increase), New York (53 percent increase), Indiana (36 percent increase), Pennsylvania (35 percent increase), Connecticut (34 percent increase), Illinois (31 percent increase), Maryland (28 percent increase), South Carolina (16 percent increase), North Carolina (14 percent increase), and Florida (14 percent increase). Among judicial states foreclosure activity in the third quarter decreased on annual basis in Massachusetts (16 percent decrease) and Wisconsin (12 percent decrease).

However, more foreclosures may be in store. ?It was recently reported that the nation?s five largest mortgage servicers have implemented all of the 320 servicing standards required under the national mortgage settlement. The continued decline in Foreclosure Starts clearly shows that even though servicers are now apparently in compliance and clear to move forward with foreclosures, they are still in no rush to foreclose on the majority of delinquent borrowers,? said Sean O?Toole, founder & CEO of ForeclosureRadar.

However, processing time actually increased durinmg the quarter to a national average of 382 days to complete the foreclosure process, up from 378 days in the previous quarter and up from 336 days in the third quarter of 2011. It was the highest average number of days to foreclose since the first quarter of 2007.

The average time to complete a foreclosure increased substantially from a year ago in several states where recent legislation and court rulings have extended the foreclosure process. These states included Oregon (up 62 percent to 193 days), Hawaii (up 62 percent to 662 days), Washington (up 62 percent to 248 days) and Nevada (up 42 percent to 520 days).

The average time to foreclose decreased from a year ago in 15 states, including Arkansas (down 49 percent to 199 days), Michigan (down 15 percent to 226 days), Maryland (down 9 percent to 541 days), California (down 8 percent to 335 days), and New Jersey (down 4 percent to 931 days).

New Jersey documented the second longest state foreclosure timeline in the third quarter behind New York, where the average time to complete a foreclosure was 1,072 days for properties foreclosed during the quarter. Florida registered the third highest state foreclosure timeline, 858 days - down slightly from 861 days in the previous quarter - and Illinois registered the fourth highest state foreclosure timeline, 673 days.

2.2 Surcharge on Income tax:

2.3.1 Education Cess on Income tax:

The amount of income-tax shall be increased by Education Cess on Income Tax at the rate of two per cent of the income-tax.

2.3.2 Secondary and Higher Education Cess on Income-tax:

From Financial Year 2007-08 onwards, an additional surcharge is chargeable at the rate of one per cent of income-tax (not including the Education Cess on income-tax).

Education Cess, and Secondary and Higher Education Cess are payable by both resident and nonresident assessees.

Superior of troubled Legion of Christ steps aside

(AP) ? The superior general of the troubled Legion of Christ religious order has stepped aside unexpectedly, saying he simply doesn't have the energy to oversee the radical reform of the congregation ordered by the Vatican.

The Rev. Alvaro Corcuera said in a letter obtained Thursday that his vicar general, the Rev. Sylvester Heereman, would govern the order until a planned general assembly in 2013 or 2014 to elect a new superior. Corcuera will retain his title, but no longer run the Legion.

The Legion has been in turmoil ever since it acknowledged in 2009 that its founder, the late Rev. Marcial Maciel, sexually abused his seminarians and fathered three children. The Vatican took it over in 2010 after a yearlong investigation determined that the Legion's very culture had been infected by Maciel's influence and needed to be "purified."

Corcuera worked closely with Maciel after being named superior in 2005 but has insisted he didn't know of Maciel's crimes. Nevertheless, Legion critics have long demanded his removal, saying the entire Legion leadership should have stepped aside as soon as the revelations of Maciel's double life came out, and that no real reform can take place as long as Maciel's hand-picked subordinates remain in positions of power.

Earlier this year, Corcuera admitted that he knew in 2005 that the Legion's most prominent priest, the Rev. Thomas Williams, had fathered a child, yet he kept the news secret and allowed Williams to keep teaching and preaching about morality.

Williams admitted his parternity publicly in May after inquiries by The Associated Press and is no longer teaching.

In his letter, Corcuera said that even though he isn't suffering from any specific illness, he doesn't have the "health and energy necessary to responsibly deal with the requirements of governing" the Legion and its lay movement Regnum Christi as it undergoes the Vatican-mandated reform process.

The pope's delegate overseeing the reform of the Legion, Cardinal Velasio De Paolis, said in an accompanying letter that he accepted Corcuera's decision with regret.

"It's a painful decision that has brought suffering to everyone, but is believed necessary for the good of the Legion and Father Alvaro himself," De Paolis wrote.

De Paolis has said he needed the Legion's leadership to stay in place during the reform process, saying his aim wasn't to decapitate the Legion's governing structure but rather change the culture and mindset of its entire membership.

The scandal surrounding the Legion is particularly grave given that Maciel was held up as a model for the faithful by Pope John Paul II, who was impressed by the orthodox order's ability to attract money and young men to the priesthood.

Maciel's double life, and the continuing problems of the cult-like order, have cast a shadow over John Paul's legacy. The Vatican knew of Maciel's crimes as early as the mid-1950s, yet he continued to enjoy the highest Vatican praise and access until he was finally sanctioned by Rome in 2006. Maciel stepped down as superior in 2005, when Corcuera took over.
